In Ohio, an uncontested divorce occurs when one spouse files a complaint for divorce and the other either doesn’t respond within 28 days or files a response agreeing to all terms.   2. File the Complaint and Pay the Filing Fee: The filing fee is $375 for a divorce without minor children and $475 for a divorce involving children. If the fee creates a financial hardship, a Poverty Affidavit may be submitted to the court.

  6. Submit the Final Judgment and Decree: At least 21 days before the final hearing, the filing party must submit a Final Judgment and Decree of Divorce to the Compliance Office for review.
  7. Attend the Final Hearing: The judge reviews the submitted paperwork and may ask questions. If the agreement satisfies Ohio law requirements, the judge may sign the decree.
  8. Receive the Final Decree: The divorce isn’t final until the judge signs the Final Judgment and Decree of Divorce and it is filed with the Montgomery County Clerk of Courts. That filing date is when the marriage is legally ended.
